Acceptance of Terms
These Terms of Service govern your use of the Cheesy Records TV website and services. By accessing our website, submitting your music, or purchasing a service, you agree to these terms. If you do not agree, please do not use our website or services.
Who We Are
Cheesy Records TV is the customer-facing brand operated by Next Level 360 LLC, a Wyoming limited liability company. Throughout these terms, the words "we", "us", and "our" refer to Next Level 360 LLC in connection with the Cheesy Records TV brand. The words "you" and "your" refer to the artist, customer, or visitor using our website or services.
Our Services
We provide promotional services and placements for independent artists. These are described on our Services page and may include IG Story promotion, IG feed posts, written artist interviews, website publication, and placements on our own network pages using artist submitted assets. Each package lists its placement counts and formats on our Services page. Before payment, we confirm your order in writing as described below. Our packages use assets you supply and do not include filming or video production.
No Guaranteed Results and No Sale of Engagement
This section is important. Please read it carefully.
What you purchase is the promotion and placement of your music to our own channels and audience. Any views, plays, or follower growth that result vary and are never guaranteed. We provide promotional services, content, and placements only. We do not sell, guarantee, or fabricate followers, likes, views, plays, streams, or any other social-media engagement, and we never use bots, fake accounts, or artificial activity of any kind. Rare paid Instagram promotion, described under Pricing and Payment, is distinct from fabricated or artificial activity and does not guarantee any result.
All reach and metric outcomes vary by release, audience, timing, and platform behavior, and they are never guaranteed. Nothing on our website or in any communication should be read as a promise of a specific number of views, streams, plays, followers, or any other result.
Network placements are published on social media pages owned by Cheesy Records TV. We identify the participating pages to you privately and confirm placement formats and durations with you in writing before payment. Next Level 360 LLC remains responsible to you for delivering your purchased service and handling refunds. We do not guarantee views, plays, followers, streams, or social-media engagement from these placements.
Eligibility
You must be the age of majority in your place of residence to purchase our services, or you must have permission from a parent or legal guardian who agrees to these terms on your behalf. By using our services, you confirm that you meet this requirement.
Your Submissions and Content
When you submit music, artwork, or other materials, you confirm that you own or control all rights to that content, including any samples, beats, or featured artists involved. You are responsible for obtaining all clearances, licenses, and permissions needed for us to promote your work.
You grant Cheesy Records TV a license to use, publish, distribute, and promote your submitted content across our channels for the purpose of providing the services you purchased. This license lasts as long as is reasonably needed to deliver and maintain the promotion. You keep ownership of your music and creative work.
Our Content
We retain ownership of our brand, channel, logos, original content, and the materials we create to operate our services. Nothing in these terms transfers ownership of our intellectual property to you.
Pricing and Payment
Package prices are listed in U.S. dollars and are one time charges. Before payment, we confirm in writing your package, placement counts and formats, total price in U.S. dollars, participating pages, placement durations, publication window, and payment instructions. The listed prices are our standard prices, and we occasionally offer discounts to individual customers; any discount is reflected in the total price confirmed in writing before payment. On rare occasions, we use paid Instagram promotion to boost a customer's placement. Boosting is not a listed package deliverable, and it does not guarantee views, plays, streams, followers, or any other result.
Delivery
Your publication window is confirmed in writing before payment. It starts once we have received both the required payment and your required assets, such as music links, artwork, and your bio. Delays in providing assets will move the publication window accordingly. After publication, we send a delivery report with links or screenshots.
Refunds
Refunds and cancellations are governed by our Refund & Cancellation Policy. Please review that policy for full details on eligibility, prorated refunds, and non-refundable items.
Acceptable Use
You agree not to submit content that is unlawful, infringing, hateful, defamatory, or fraudulent. We may decline, pause, or remove any content or order at our discretion, including content that violates these terms or the rules of the platforms we work with. If we decline your paid order before work begins, you receive a full refund.
Disclaimers
We deliver the placements and content described in your confirmed package. If we fail to deliver them within the agreed publication window due to our own fault, the remedies in our Refund & Cancellation Policy apply. We do not promise or warrant any specific result, including views, plays, streams, followers, engagement, or income. To the fullest extent permitted by law, we disclaim all other warranties not expressly stated in these terms.
Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from a service is limited to the amount you paid us for that specific service. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost opportunities.
Indemnification
You agree to indemnify and hold harmless Next Level 360 LLC, operating as Cheesy Records TV, from any claims, damages, or costs arising from your content, your use of our services, or your breach of these terms. This includes claims that your submitted content infringes the rights of a third party.
Order Terms
The order details we confirm in writing before payment, including your package, total price in U.S. dollars, participating pages, placement durations, and publication window, form part of your agreement with us. If something is wrong with your order, please contact us first so we can try to resolve it. This does not limit any rights you have with your bank or card issuer.
Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will revise the date at the top of this page. Your continued use of our website or services after a change means you accept the updated terms.
