These Terms of Service govern your use of the Cheesy Records TV website and services. By accessing our website, submitting your music, or purchasing a service, you agree to these terms. If you do not agree, please do not use our website or services.
Who We Are
Cheesy Records TV is the customer-facing brand operated by Next Level 360 LLC, a Wyoming limited liability company. Throughout these terms, the words "we", "us", and "our" refer to Next Level 360 LLC in connection with the Cheesy Records TV brand. The words "you" and "your" refer to the artist, customer, or visitor using our website or services.
Our Services
We provide promotional services and placements for independent artists. These are described on our Services page and may include IG Story promotion, IG feed posts, written artist interviews, website publication, and brand-managed network page placements using artist submitted assets. The specific scope, deliverables, and timeframe for each service are described in the package you purchase.
No Guaranteed Results and No Sale of Engagement
This section is important. Please read it carefully.
What you purchase is the promotion and placement of your music to our own channels and audience. Any views, plays, or follower growth that result come organically from that real exposure. We provide promotional services, content, and placements only. We do not sell, buy, guarantee, or fabricate followers, likes, views, plays, streams, or any other social-media engagement, and we never use bots, fake accounts, or artificial activity of any kind.
All reach and metric outcomes vary by release, audience, timing, and platform behavior, and they are never guaranteed. Nothing on our website or in any communication should be read as a promise of a specific number of views, streams, plays, followers, or any other result.
Brand-managed network page placements, when included, are confirmed with the customer before payment. We cannot and do not guarantee any specific number of views, plays, followers, streams, or social-media engagement from those placements.
Eligibility
You must be the age of majority in your place of residence to purchase our services, or you must have permission from a parent or legal guardian who agrees to these terms on your behalf. By using our services, you confirm that you meet this requirement.
Your Submissions and Content
When you submit music, artwork, or other materials, you confirm that you own or control all rights to that content, including any samples, beats, or featured artists involved. You are responsible for obtaining all clearances, licenses, and permissions needed for us to promote your work.
You grant Cheesy Records TV a license to use, publish, distribute, and promote your submitted content across our channels for the purpose of providing the services you purchased. This license lasts as long as is reasonably needed to deliver and maintain the promotion. You keep ownership of your music and creative work.
Our Content
We retain ownership of our brand, channel, logos, original content, and the materials we create to operate our services. Nothing in these terms transfers ownership of our intellectual property to you.
Pricing and Payment
Package prices are listed in U.S. dollars. The final scope and payment instructions are confirmed directly in writing before work begins. We do not collect or manage advertising budgets or purchase paid advertising on a customer's behalf.
Delivery
Delivery timeframes are listed per package. A timeframe starts once we have received the required assets from you, such as music links, artwork, and your bio. Delays in providing assets will move the delivery window accordingly.
Refunds
Refunds and cancellations are governed by our Refund & Cancellation Policy. Please review that policy for full details on eligibility, prorated refunds, and non-refundable items.
Acceptable Use
You agree not to submit content that is unlawful, infringing, hateful, defamatory, or fraudulent. We may decline, pause, or remove any content or order at our discretion, including content that violates these terms or the rules of the platforms we work with.
Disclaimers
Our services are provided "as is" and "as available". We make no warranty, express or implied, that any specific result, metric, or placement will be achieved. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these terms.
Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from a service is limited to the amount you paid us for that specific service. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost opportunities.
Indemnification
You agree to indemnify and hold harmless Cheesy Records TV from any claims, damages, or costs arising from your content, your use of our services, or your breach of these terms. This includes claims that your submitted content infringes the rights of a third party.
Governing Law
Any service-specific terms, including the process for resolving a dispute, are confirmed in writing before work begins.
